WORKPLACE INVESTIGATION TEMPLATES

1) Not Legal Advice / No Attorney‑Client Relationship
These materials are provided for general informational and administrative purposes only. They are not legal advice and do not create an attorney‑client relationship between the provider and any user or agency. Users should consult their agency counsel regarding any specific facts, legal requirements, or strategic decisions.
2) Local Policy & Law Control
Where these templates conflict with applicable law, civil service rules, collective bargaining agreements, charter provisions, or agency policies/procedures, those sources control. Users are responsible for verifying and tailoring the templates for local requirements and bargaining obligations.
3) Public Records & Confidentiality
Use and disclosure of documents generated with these templates may be subject to Louisiana’s Public Records Law (La. R.S. 44:1 et seq.) and any applicable exemptions. Coordinate with agency counsel before releasing or withholding records. Maintain confidentiality on a need‑to‑know basis and comply with all anti‑retaliation protections.
4) Records Retention & Litigation Hold
Users are responsible for implementing appropriate records‑retention schedules and preservation (litigation) holds when litigation, charges, audits, or investigations are reasonably anticipated. Do not alter or destroy potentially relevant records.
5) Equal Employment & Safety Compliance
Users must ensure the investigative process complies with applicable federal and state requirements (including, as applicable, Title VII, ADA, ADEA, FLSA, OSHA, Title IX, and Louisiana equivalents). Nothing in these materials diminishes employee rights (including whistleblower protections under La. R.S. 23:967) or any due‑process, grievance, or appeal rights.
6) Accessibility & Language Access
Provide reasonable accommodations (e.g., interpreters, accessible formats) for participants with disabilities or limited English proficiency, consistent with applicable laws and agency policy.
7) Privacy, Security & Sensitive Information
Handle personally identifiable information (PII), medical information, and other sensitive data securely. Limit access to those with a legitimate business need. When sharing externally, consider redaction and consult counsel.
8) No Warranties / Fitness for Purpose
These materials are provided “AS IS,” without warranties of any kind, express or implied, including but not limited to accuracy, completeness, merchantability, or fitness for a particular purpose. The provider does not warrant outcomes or compliance.
9) Limitation of Liability
To the maximum extent permitted by law, the provider shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of these materials. Direct damages, if any, shall be limited to the amount paid (if any) for the materials.
10) Modification & Version Control
Users should revise templates to reflect current law and policy, maintain version control, and clearly date any modifications. Periodically review and update to reflect legal or policy changes.
11) No Endorsement / Use Authorization
Use does not constitute an endorsement by the provider, and vice versa. Agencies may reproduce and adapt these templates for internal, non‑commercial use. Redistribution outside the agency should retain this disclaimer.
12) Governing Law & Venue
These terms are governed by the laws of the State of Louisiana. Any dispute relating to these materials shall be brought in a court of competent jurisdiction in Louisiana.
